TERMS AND CONDITIONS OF USE FOR COLLEGETIX™ BY TICKET BUYERS
Sylver Productions requires all CollegeTix™ ticket buyers and purchasers to understand that they agree to all of the following terms and conditions described below:
1. CollegeTix
CollegeTix™ and Sylver Productions are not affiliated with any event organizers or promoters for which tickets are purchased. CollegeTix is merely an online ticketing service provider connecting ticket vendors to purchasers for specific events. CollegeTix™ and Sylver Productions will assume no liability incidental to the event for which tickets are sold or purchased. The ticket purchaser assumes all risks associated with attendance of events.
2. Ticket Delivery
Ticket delivery will be determined by the organizer. CollegeTix™ does not issue paper tickets; only printed receipts of payment may be used as proof of payment. CollegeTix™ prepares a master guest list for every event. The ticket purchaser assumes all risk of ticket loss, theft, delay, damage or destruction after purchase of ticket(s). Tickets lost, stolen, delayed, damaged or destroyed will not be replaced.
3. Guest List
Ticket purchasers will automatically have their names on the master guest list for the event. CollegeTix™ does not issue paper tickets. A valid piece of photo identification (ID) or the original credit card used must be presented in order to gain entry into event unless otherwise instructed by the organizers. Refunds at venue will not be granted if ticket purchaser fails to provide photo identification and/or the original credit card used to make the ticket purchase. Ticket purchaser understands and agrees that ticket purchaser’s full name and city will be released to organizers and/or venue in order to ensure ticket purchaser’s identity.
4. Cancelled/Rescheduled Events
The organizers or others outside the control of CollegeTix™ and Sylver Productions may cancel or reschedule events. It is at the producer’s discretion whether to refund the ticket price or exchange the tickets for a similarly equivalent event should a cancellation or rescheduling occur. CollegeTix™ will provide instructions on its site (via the link for said event) on how to exchange event specific tickets or obtain ticket price refunds, should the event be cancelled or rescheduled. Service charges will not be refunded in the event of a cancelled or rescheduled event.
5. Pricing, Availability and Seating
a. Event ticket prices and the number of tickets to be sold are set by the event organizers, not CollegeTix™ or Sylver Productions. CollegeTix™ and Sylver Productions will not be held liable for ticket over sales outside the online platform. Should tickets be oversold, the organizer has discretion as to the method of refund, including, but not limited to event price refund or ticket exchange for a similarly equivalent event.
b. Venue seating charts are provided by organizers and/or the venue, not CollegeTix™ or Sylver Productions. CollegeTix™ and Sylver Productions is not responsible for incorrect seating information or ticket holder dissatisfaction with selected seating. Any seating dispute is between ticket purchaser and organizer and/or venue. Service charges will not be refunded if event tickets are oversold, or if a ticket purchaser is dissatisfied with selected seating.
6. Lost, Stolen, Destroyed Tickets
Lost, stolen, delayed, damaged or destroyed tickets will not be replaced or refunded, including tickets lost, stolen, delayed, damaged, or destroyed after purchase by the ticket purchaser.
7. Refunds and Exchanges
Please review ticket ordering information very carefully prior to ticket purchase because sales are final. The SKA Group Inc. (on behalf of CollegeTix™ and Sylver Productions) may issue a refund only after/within fifteen (15) business days from date of purchase for a $1.50CAD fee per ticket. CollegeTix™ and Sylver Productions will however never exchange tickets; except instructed by the organizer, but the ticket purchaser is not obligated to accept the exchange ticket in place of a refund.
8. Privacy Policy
CollegeTix™ requires the ticket purchaser to provide full name and contact information, including mailing address, email address and telephone number. Once ticket purchaser opts to provide name and contact information for the purchase of tickets to organizers’ event, CollegeTix™ is required to provide a certain amount of that information to the organizer. Ticket purchaser should know that only the ticket purchaser’s name and city will be passed on to the organizer.
9. Order Cancellation
CollegeTix™ and Sylver Productions reserves the right to cancel ticket orders for any reason, not limited to incorrect billing information and/or fraudulent ticket purchasing.
10. Resale of Tickets
Tickets purchased via CollegeTix™ are for individual use only and not for resale. Resale will automatically void tickets, bar refunds, bar exchanges and bar entry into event.
11. Disputes
Any dispute brought by the ticket purchaser against CollegeTix™ and/or Sylver Productions will be governed by the Province of Ontario. It is agreed that in the event any legal action is instituted against CollegeTix™ and/or Sylver Productions, the ticket purchaser agrees that jurisdiction and venue will be in Canada at the John Sopinka Courthouse at 45 Main Street East, Hamilton, Ontario. However, in no event will CollegeTix™ and Sylver Productions’ total cumulative damages exceed $100.00CAD.
12. Effective Date
These terms and conditions are effective as of Wednesday, September 21st, 2011.
